There are two primary laws governing cosmetics sold in the United States. These include: Understanding the reach of these two acts is vital in order for consumers to know how best to ensure the safety of products they bring into their homes. Here is a brief overview of each:
FD&C Act
This act prohibits the sale of adulterated or misbranded cosmetics in interstate commerce. Violations that include the actual product itself - whether this involves intentional ingredients, contaminants, how the product is processed, packaging, shipping or handling and cause the product to become adulterated are subject to regulatory action.
FPLA
This act requires proper ingredient disclosure on the back label. Ingredients should be listed by INCI name and in descending order. Failure to properly disclose ingredients results in misbranded cosmetics, which is in violation of the FD&C Act.
